In accordance with the following user terms ('User Terms'), TMG Ukraine ('TMG') grants you as an authorised user ('Authorised User' or 'you') of this TMG web site ('Web Site') certain rights (as set out below) and in return you agree to perform certain obligations.  Please read these User Terms carefully. They are a legal document and, by your continued use of the Web Site, you agree to be bound by these User Terms. In particular, you agree that you have read and understood them.

1. Using material of TMG
TMG grants to you a personal, non-exclusive, non-transferable, royalty-free licence to use provided material on the Web Site (included but not limited: documentation, text, covers, articles, video or audio clips, and advertising material) ('TMG Material') on the following basis:
You are entitled to access, download and store the TMG Material for your own personal, non-commercial use provided that you do not:
·  remove any notices relating to the ownership of copyright or other Intellectual Property Rights in the TMG Material;
·  modify, translate, reproduce or create derivative works of any of the TMG Material;
·  rent, lease, sub-licence, loan, copy or give or transfer any rights in the TMG Material in any form, to any person or entity without the prior written consent of TMG.

Each time when you use the site or the information on the site, you agree that you shall not:
·  violate any laws of Ukraine;
·  infringe any third-party rights;
·  submit false or misleading information;
·  distribute spam, pyramid schemes or chain letters;
·  distribute viruses or any other technologies that may harm and affect the proper working of the Web Site;
·  interfere with the functioning of the Web Site.

2. Intellectual property
Notwithstanding the limited rights granted to you in accordance with clause 1, TMG shall retain all ownership of intellectual property right of the TMG Material. You can use this site strictly within the limits of these Terms and the legislation of Ukraine on copyrights.

3. Duration of User Terms
These User Terms are binding upon you immediately. You accept them by your use of this Web Site and TMG reserves the right to change these Terms at any time.

4. Responsibilities
TMG Ukraine takes no liability for any failure or interruption of the Web Site or any inability to access or use of features, products or services on the Web Site. We cannot grant you that the published information is liable for the purpose for which you consult this Web Site. Therefore TMG takes no liability for any (direct or indirect) damage that will result from the use of this Web Site.

The Web Site may contain links to third party web sites which are not controlled and operated by TMG.  Via those links you will leave the Web Site and TMG is not responsible for the content of any linked site. If you decide to access linked (third party) web sites, you do so at your own risk.

The goods and services ("Merchandise") which may be purchased by you from companies or individuals other than TMG ("Merchants") via third party and/or third party web sites linked to this Web Site are subject to separate terms and conditions between you and the applicable Merchant. You acknowledge that the applicable Merchant (and not TMG) is solely responsible for the fulfilment of orders for any Merchandise and for its quality, suitability and fitness for purpose. You also acknowledge that the selection of any Merchant or the purchase of any item of Merchandise from the information available on the Web Site or from the Merchant via the Merchant's web site or otherwise is solely your choice. 5. General
These User Terms are governed by the laws of Ukraine, and subject to the jurisdiction of the  Courts of Ukraine.
